有道WP插件最终用户服务条款

服务条款的确认和接纳

有道WP插件的所有权和运作权归网易有道信息技术(北京)有限公司(以下简称“有道公司”)所有。所提供的服务必须按照其发布的公司章程,服务条款和操作规则等严格执行。用户下载前需要阅读服务条款,这表示用户与有道公司达成并接受以下所有条款。本服务条款的最终解释权归有道公司所有。

1、简介

有道公司运用自己的操作系统通过国际互联网络为用户提供有道WP插件服务。用户必须:

(1)认真阅读并知晓有道WP插件产品介绍,遵守本服务条款和相关操作规则。

(2)采用WordPress搭建个人博客。

(3)遵守中华人民共和国相关法律法规(如果用户是中华人民共和国境外的使用者,还应遵守所属国家或地区的法律法规)。

2、声明

有道WP插件开发过程中利用了WordPress的开放插件接口,因此若用户发布、复制、修改有道WP插件同样需要遵守GPL(GPL请见本服务条款附件)。如果对有道WP插件进行了修改,用户必须在修改的文件中附有明确的说明:修改有道WP插件及具体的修改日期。

3、使用要求

用户在使用有道WP插件时,不得损害、禁用、影响有道搜索服务或使有道搜索服务负担过重,也不得影响任何其它方享用有道搜索服务。如果用户对有道WP插件有任何意见,或有如何改进的建议,可向有道公司提出。请注意,如果这样做,还会授予有道公司和第三方在有道WP插件(或第三方软件)中无偿使用和加入用户的建议或意见的权利。

4、知识产权

用户承认有道公司对有道WP插件中其自行开发的部分享有相关权利,包括但不限于知识产权。用户同意不会删除、掩盖或更改有道公司或任何第三方的版权声明、商标或其它所有权声明。

5、用户隐私制度

尊重用户个人隐私是有道公司的一项基本政策。所以,有道公司一般不会公开、编辑或透露用户保存在有道公司服务中的非公开内容,除非有道公司在诚信的基础上认为透露这些信息在以下几种情况是必要的:

(1)遵守有关法律规定,包括在国家有关机关查询时,提供用户通过有道WP插件搜索、浏览或发布的信息内容及其发布时间、互联网地址或者域名。

(2)遵从有道WP插件的服务程序。

(3)保持维护有道公司及其关联公司的商标等知识产权。

(4)在紧急情况下竭力维护用户个人和社会大众的隐私安全。

(5)有道公司认为必要的其他情况下。

6、服务变更

有道公司保留随时变更、中断或终止服务而不需通知用户的权利。用户接受有道公司行使变更、中断或终止服务的权利,有道公司不需对用户或第三方负责。

7、责任限制

用户理解并同意自主选择下载和/或使用有道WP插件和所有与有道WP插件一同提供或通过有道WP插件提供的插件,风险自负,并且对于因下载或使用有道WP插件和此类第三方插件而对计算机系统造成的损坏或数据的丢失,用户应承担全部责任。

在适用法律允许的最大范围内,有道公司明确表示不提供任何其他类型的保证,不论是明示的或默示的,包括但不限于适销性、适用性、可靠性、准确性、完整性、无病毒以及无错误的任何默示保证和责任。另外,在适用法律允许的最大范围内,有道公司并不担保有道WP插件一定能满足用户的要求,也不担保有道WP插件不会被修改、中断或终止,并且对有道WP插件的及时性、安全性、错误发生,以及信息是否能准确、及时、顺利的传送均不作任何担保。

在适用法律允许的最大范围内,有道公司不就因用户使用有道WP插件引起的,或在任何方面与有道公司的产品和服务有关的任何意外的、非直接的、特殊的、或间接的损害或请求(包括但不限于因人身伤害、因隐私泄漏、因未能履行包括诚信或合理谨慎在内的任何责任、因过失和因任何其他金钱上的损失或其他损失而造成的损害赔偿) 承担任何责任。

有道WP插件自动推荐的相关博文数据由机器自动生成,有道公司对博文数据及其所指向的文章内容的相关性、正确性及合法性不作任何担保,不承担任何责任。

8、有道搜索服务

有道WP插件的部分功能是与有道搜索服务配合使用。因此,用户使用有道WP插件时,还应遵守有道公司及其关联公司的其他服务条款规定。

9、保障

用户同意保障和维护有道公司的利益,负责支付由用户违反本服务条款或有道公司其他服务条款而引起的律师费用、损害补偿费用、政府机关处罚费用和其它侵权赔偿费用等。

10、通知

有道公司所有发给用户的通知可通过重要页面的公告或电子邮件或常规的信件传送。同时,用户在此授权有道公司可以向其电子邮箱发送商业信息。

11、法律

上述条款将受中华人民共和国法律的约束并依据其解释。如出现纠纷,用户和有道公司一致同意将纠纷交由北京市海淀区人民法院管辖。

上述条款是各方针对本文主题的全部协议,优先于并取代所有以前或同期对此类主题的书面或口头的规定或协议。要排除上述任何条款,必须采取书面形式,并得到有道公司和/或与有道WP插件一同提供或通过有道WP插件提供其软件的第三方书面签字,才能生效。
